The Measures for the Administration of Electric Bicycles in Shandong Province have made clear provisions on the production, sales, registration, passage, parking and related management activities of electric bicycles.

▼ The Measures for the Administration of Electric Bicycles in Shandong Province, Chapter 1, General Provisions, Article 1, is to strengthen the administration of electric bicycles, maintain road traffic order, prevent and reduce road traffic The Measures are formulated in accordance with the Road Traffic Safety Law of the People’s Republic of China, the Fire Protection Law of the People’s Republic of China, the Measures of Shandong Province for the Implementation of the Road Traffic Safety Law of the People’s Republic of China and other laws and regulations, and in combination with the actual situation of the province, to protect the personal and property safety of citizens in case of fire accidents.

Article 2 These Measures shall apply to the production, sales, registration, passing, parking, charging and related management activities of electric bicycles in the administrative areas of this province.

The electric bicycle referred to in these Measures is a non motor vehicle, which refers to a two wheeled bicycle that conforms to the relevant national technical standards, uses an on-board battery as an auxiliary energy source, has the function of pedaling, and can realize the function of electric assistance or electric drive.

Article 3 The management of electric bicycles shall follow the principles of scientific planning, ensuring safety, co governance, efficiency and convenience.

Article 4 The people’s governments at or above the county level shall strengthen their leadership over the management of electric bicycles within their administrative areas, establish a work coordination mechanism, guarantee the funds needed for work, and urge the relevant departments to perform their duties according to law.

The township people’s governments and sub district offices shall urge the units under their jurisdiction to implement the responsibilities for traffic safety and fire safety of electric bicycles.

The villagers’ committee and the residents’ committee shall assist in relevant work according to law.

Article 5 The public security department shall be responsible for the road traffic safety management of electric bicycles.

The market supervision and administration department is responsible for the supervision and administration of compulsory product certification of electric bicycles, as well as the supervision and inspection of the quality of electric bicycles, chargers, batteries and other products produced and sold.

Fire rescue institutions and police stations shall be responsible for the fire safety management, supervision and inspection of electric bicycles according to their respective responsibilities.

Development and reform, industry and informatization, finance, ecological environment, housing and urban and rural construction, transportation, commerce, urban management, banking and insurance supervision, postal administration and other departments and units shall, according to their respective responsibilities, do a good job in the management of electric bicycles.

Article 6 The people’s governments at all levels shall organize and carry out publicity and education on road traffic safety and fire safety of electric bicycles, as well as laws, regulations and rules, to guide citizens to travel in a safe, civilized and green way.

The education administrative departments and schools shall incorporate the traffic safety and fire safety education of electric bicycles into the legal publicity and education.

State organs, public organizations, enterprises, institutions and other organizations shall strengthen the publicity and education of the safety knowledge of electric bicycles for their personnel.

The news media should strengthen the publicity of the common sense of electric bicycle safety and relevant laws, regulations and rules.

Article 7 The driver of an electric bicycle shall consciously abide by the relevant laws, regulations and rules on road traffic safety, fire safety, urban management, etc., drive safely and in a civilized manner, park vehicles in an orderly manner, and maintain fire safety.

We will encourage the public to participate in voluntary services for the management of electric bicycles according to law, and assist in the management of electric bicycles.

Article 8 The electric bicycle related industry associations shall establish industry norms, strengthen industry self-discipline, guide and supervise the member units to engage in the production, sales, maintenance, recovery and other activities of electric bicycles and their related products according to law, and promote the healthy and orderly development of the electric bicycle industry.

Chapter II Production and Sales Article 9 The electric bicycles produced and sold in the administrative region of this province shall meet the mandatory national standards and obtain the compulsory product certification certificate.

The electric bicycle batteries, chargers and other products produced and sold shall conform to the relevant national standards.

Article 10 The seller of electric bicycles shall perform the obligation of purchase inspection, establish purchase and sales accounts, and publicize the relevant information about the electric bicycles sold that meet the mandatory national standards and have obtained the mandatory product certification at a conspicuous place in the sales place; If the goods are sold through the e-commerce platform, the disclosed commodity information shall include the above relevant information.

The operator of the e-commerce platform shall verify and register the identity certificate (business license), address, contact information, product certification and other information of the seller who applies to enter the platform to sell electric bicycles; If it is found that the electric bicycles sold on the platform violate the relevant laws and regulations, it shall take necessary disposal measures according to law and report to the relevant competent department.

Article 11 The producers and sellers of electric bicycles are encouraged to recycle the discarded electric bicycles by means of trade in or buy back at a discount.

Article 12 The producers and sellers of electric bicycles and their batteries shall provide services for the replacement and recovery of waste batteries of electric bicycles, and establish a recycling account.

Waste batteries of electric bicycles shall be disposed of according to the relevant regulations on solid waste pollution prevention and control, and shall not be discarded at will.

Article 13 No unit or individual may produce or sell electric bicycles under the following circumstances: (1) assembled; （2） Refitting power devices such as motors and storage batteries, or replacing motors and storage batteries that do not conform to mandatory national standards; （3） Refitting speed devices so that the maximum speed per hour exceeds the mandatory national standards; （4） Adding seats, umbrellas, lamps, awnings, carriages and other devices, and changing the shape and structure of the vehicle affects driving safety; （5） Altering or forging the vehicle code; （6） Other circumstances stipulated by laws and regulations.

Chapter III Registration and Passage Article 14 When an electric bicycle is driven on the road, it shall be registered with the traffic control department of the public security organ of the people’s government of a city or county (city or district) divided into districts according to law, and obtain the number plate of the electric bicycle..
