Article 01 of Chapter I General Provisions of the Interim Administrative Measures for Non motor Vehicle Sharing in the Urban Area of Laibin City Article 01 These Measures are formulated in combination with the actual situation of the city in order to guide and standardize the orderly development of the non motor vehicle sharing industry in the urban area of Laibin City, improve the service level of non motor vehicle sharing enterprises, meet the travel needs of the people, and maintain the public order and good city appearance.
Article 2 These Measures shall apply to the operation, service, use, supervision and administration of shared non motor vehicles in the urban areas of this Municipality.
The term “shared non motor vehicles (only bicycles and electric bicycles)” as mentioned in these Measures refers to the operating non motor vehicles that are launched for business purposes by the shared non motor vehicle operating enterprises (hereinafter referred to as “operating enterprises”) based on the Internet service platform and provide users with time-sharing lease and other services.
Article 3 The city adheres to the principle of “municipal overall planning, multi-party governance, and enterprise ownership”.
The government, enterprises, society, and tenants form a joint force to jointly promote the standardized development and management of shared non motor vehicles, and jointly maintain a good urban environment and traffic order.
The operating enterprise shall bear the main responsibility for the operation and management of the vehicles to be put into operation; Sharing non motor vehicles in public areas is consistent with the parking rules of ordinary non motor vehicles; Both the enterprise and the lessee shall bear their own responsibility for standardized parking.
Article 4 A leading group for the management of shared non motor vehicles in Laibin City (hereinafter referred to as the “leading group”) shall be established to organize, lead and coordinate the launching and operation of shared non motor vehicles.
The group leader shall be the deputy mayor of the municipal people’s government in charge of urban construction, the deputy group leader shall be the deputy secretary-general of the municipal people’s government in charge of urban construction with the assistance of the municipal people’s government, the director of the municipal urban management bureau, and the members shall be the Publicity Department of the municipal party committee, the Internet Information Office of the municipal party committee, the municipal judicial bureau, the municipal urban management bureau The Municipal Market Supervision Bureau, the Municipal Development and Reform Commission, the Municipal Transportation Bureau, the Municipal Natural Resources Bureau, the Municipal Public Security Bureau, the Municipal Government Affairs and Big Data Development Bureau, the Laibin Banking and Insurance Regulatory Branch and the Xingbin District People’s Government are composed of responsible comrades.
The office of the leading group is located in the Municipal Urban Management Bureau.
The director of the office is concurrently the director of the Municipal Urban Management Bureau, and the deputy director is concurrently the leader of Xingbin District People’s Government, the Municipal Urban Management Bureau, the Municipal Development and Reform Commission and the leader of the traffic police detachment of the Municipal Public Security Bureau.
The Office is responsible for establishing relevant joint management mechanisms among functional departments, coordinating and sharing the development of the non motor vehicle industry, and organizing the formulation of relevant policy management and work specifications; Review the dynamic management and daily organization and coordination of the exit of operating enterprises and the sharing of non motor vehicle delivery indicators; Supervise and inspect the vehicle release and operation of the operating enterprise.
Article 5 All relevant departments shall share information, strengthen communication, take the initiative in accordance with their respective responsibilities, work solidly and do a good job in the supervision and management of sharing non motor vehicles.
The Municipal Development and Reform Commission is responsible for organizing the relevant departments to coordinate the access of non motor vehicle sharing projects in the urban area of the city according to the regulations, and reporting to the municipal people’s government for approval according to the procedures after reaching an agreement with the operating enterprises.
The Municipal Urban Management Bureau shall be responsible for approving the road occupation permit for sharing non motor vehicles according to the operating enterprises and the number of vehicles that have been put into operation as determined by the signed relevant agreements; Approve the use of roads, squares and other municipal public places to set up shared non motor vehicle drop off points and parking spots; Investigate and deal with the illegal occupation of roads, squares and other municipal public places by shared non motor vehicles according to law; Use digital information to supervise the operation of shared non motor vehicles.
The Municipal Public Security Bureau is responsible for the registration management of the shared non motor vehicles that have been admitted, punishing the acts of putting into operation without registration, investigating and punishing the illegal and criminal acts involving theft and fraud of shared non motor vehicles, intentional damage and infringement of citizens’ personal information, as well as the traffic violations of users of shared non motor vehicles.
The Municipal Market Supervision Bureau is responsible for the management of sharing the operation behavior of non motor vehicles; Be responsible for investigating and dealing with the behaviors that disrupt the market order, unfair competition, or infringe on the rights and interests of consumers during the operation of enterprises.
The Municipal Transportation Bureau is responsible for the policy formulation and overall coordination of the integrated development of non motor vehicles and urban public transport.
Laibin Branch of Bank of China Insurance Regulatory Commission is responsible for coordinating with the bank of deposit within its jurisdiction to monitor the operating enterprises’ opening of special deposit accounts for user deposits and prepaid funds, and to provide users with capital risk warnings.
The Municipal Natural Resources Bureau is responsible for planning and managing the sharing of non motor vehicle traffic network and parking facilities.
The Municipal Administration and Big Data Development Bureau is responsible for sharing the technical supervision of the construction of the non motor vehicle supervision system.
Chapter II Planning and Construction 02 Article 6 The Municipal Bureau of Natural Resources and other relevant administrative departments shall incorporate the sharing of non motor vehicle slow traffic space into the planning when preparing the urban comprehensive transport system plan and other urban public transport related plans.
Article 7 When organizing the operating enterprises to plan parking areas and set up parking facilities, the Municipal Urban Management Bureau shall solicit the opinions of the Xingbin District People’s Government, the Traffic Police Detachment of the Municipal Public Security Bureau, the Municipal Transportation Bureau, the Municipal Natural Resources Bureau and other relevant departments, and inform the operating enterprises of the parking areas and other information, which shall be disclosed to the public.
